MUHAMMAD AMJAD versus STATE
He was, no doubt, nominated in the FIR, accused of reviewing the Pakistan Penal Code Section 302 evidence, but the prosecution's witnesses clearly stated that he carried a butcher's knife in his hand. He was seen running away from the yard of the house and he did not have one. The statements made by the police under Section 161, CCPC, can be dealt with, it cannot be said that their previous statements have improved. The eyewitnesses were natural witnesses as they were prisoners of the house against whom there was no enmity or ill will. The accused alleged that a knife recovery was established on the offer of the accused. The confessional statement of the accused was properly and voluntarily reviewed by the evidence of the courts and no interference in the resulting conclusions was guaranteed, according to which the Supreme Court dismissed the appeal.
