ZUBAIDA A. SATTAR versus K.B.C.A.
On receipt of a fax message complaining about the illegal construction of buildings, Constitution Pakistan 1973 Arts 199 and 185 (3), the High Court changed the constitutional jurisdiction of the High Court, the petition under Article 199 of the Constitution and issued some instructions. Who are the people affected by such instructions. The High Court also filed a constitutional petition before the High Court and said that the only complaint through fax message was related to illegal construction of buildings, but the High Court ordered that the agencies provide utility services to various buildings in the area. Directed to be connected to water, gas and electricity were supplied to them and such order was passed by the High Court without hearing the concerned parties, the petitioners further claimed that such order could not be approved at any interim stage. Because of this, a large number of people were deprived of enjoying the utility. The services that they enjoyed for years together and there was no jurisdiction under Article 199 of the Constitution to accept such a request and to pass the order of the High Court without hearing the affected parties. The Supreme Court allowed the appeal to be investigated for the dispute of the observers, observing that since the petition was still pending before the High Court and it was not finally settled, the proceedings before the High Court stayed. Could not be given, which was passed by the High Court in the order in which it obtained utility services. Was instructed to disconnect from any supply.
