MUHAMMAD BILAL versus ADDITIONAL SETTLEMENT COMMISSIONER LAND
Homeless Persons (Land Settlement) Act 1958 Sections 10 and 11 Constitution of Pakistan (1973), Article 199 Constitutional Applicants purchased land for the successor in the interest of the original Allottee, which was affected before the sale of the land. The portion of the allottee was found to be more than the original allottee, therefore, it was canceled in the name of the applicants who purchased the land in favor of the allottee who claimed in the constitutional petition. Was that they were buyers for the price, part of the allotment was canceled by name. They were not guaranteed the original allotment without the issuance of a notice and their hearing. Applicants were admittedly buyers for the price for which the change was approved, indicating that the applicants purchased the land from different plots while the rights of the applicants were with other rights, As such, the unknown order is not affected by the petitioners, therefore, having no reason to take action, their constitutional application has not been retained in the circumstances.
