SIRAJ DIN versus MUHAMMAD AKBAR
Improvement in the status of the shopkeeper during the approval of the trial appeal for pre-arrest section 21 of the Punjab Pre-Emission Act, 1935 (the vendors) did not claim improvement in the status of the disqualification unless the defendants of the trial court. The decision is not approved when the appeal is approved by. An oral sale claim is in his favor, under which his status as a pre-emptor (plaintiff), which has been claimed as an appeal, has not been concluded. And in doing so the defendants could not defeat the pre-arrest claim. The lower appellate court of the defendants found that the defendants could improve their position even during the appeal, which was contrary to the provisions of section 21A; the Punjab Pre-Emission Act, 1913, because the appellate court's decision was against the law. The trial court's decision could not be sustained, under which the plaintiffs' case will be heard. Under the circumstances the case was reinstated
