The lawsuit was filed for damages for malicious prosecution. The applicant claimed that the proceedings under Section 133, Criminal Procedure Code, 1898, had prevented / treated the nature of the proceedings, so the proceedings initiated by the petitioner against the defendant did not benefit, the accused prosecution suit. The suit against the applicant was a claim for damages for litigation. Therefore, the leave to appeal to the Supreme Court for misunderstanding was approved to investigate such disputes.
