Sections 26A, 30 and 41 were the Civil Code of Conduct (v. 1908), O XIV, R 2, O XVIII, R 2 and O XX, R 5 The complex and contested questions of law and facts which were required in the section. Decided under 26A, 30 and 41, the Arbitration Act of 1940 imposed a duty on the trial court to settle cases on which it failed to do so where the facts and the law contested and decided complex questions. No matter was settled, and the affidavits were decided, such a case would not only constitute an impartial party but also a material misconduct to prove the matter. It will ensure and generally do not plead that the court is bound to settle cases and decide each case in accordance with the terms of O XX, R 5, CPC. In the trial cases, the trial court had violated the CPC's mandatory provisions which were applicable under Section 41, Arbitration Act, 1940 and the trial court's decision in making the award roll in court was not upheld.
