GOVERNMENT OF N.-W.F.P. versus FEDERATION OF PAKISTAN
Martial Law Regulation 1959 No. 64 Pars 16, 17 and 19 Scope and Paragraphs 16, 17 and 19 apply, West Pakistan Land Reforms Regulation, 1959 (MLR64) restated land to be paid to former holder. Without it, the government can sell. The compensation for the resumed land was not immediately payable but it was deferred in the form of inheritance, which was interchangeable by the bank where the tenants sitting on the land gave the government forest cover to the government. Did not challenge the sale of the land. On the basis of non-payment of compensation, such sale by the Government was unimaginable and in no case could it be objected to by anyone who had no title to it under paragraph 16 of the Regulation. It was restarted.
