Such a development was a high offer on the negotiating table, however, the contract was legally presented to respondents for a specified amount (which was higher than the defendant's offer), on the same day. Was presented when the defendant was contracted through negotiation. Despite the fact that he did not participate in the auction proceedings, the respondent who was himself successful in obtaining the contract through negotiations in clear violation of Section 4 (3), Punjab Local Councils Lease Rules, 1990, now on Strong objections were raised that the offer made by the applicants for the increased amount could not be accepted so they could be accused of treating themselves differently. Applicant High Court directed both parties to provide fair opportunity and to safeguard the interests of all parties, including the state, to re-hold the auction to grant export tax collection rights, leasing the defendants through negotiations.
