As a result of the latter's death, it was alleged that he could not establish Alibi's request through any careful evidence but the record did not suggest the accused's false involvement. Another FIR filed thereafter showed that the accused committed the murder after the interim pre-arrest bail was granted. The complainant's brother in the case was attracted to the provisions of section 109, PPC, before the arrest, the bail was denied.
