SHABBIR HUSSAIN SHAH versus MAQBOOL AHMAD
Sindh Tenant Limitation Ordinance 1979 Section 15 Civil Code of Conduct (v. 1908), Section 144 Constitution of Pakistan (1973), Article 185 (3) In the first round of litigation, the tenants withdrew their application for leave. Appeal was prepared before the court provided the landlords granted them one year to vacate the premises; the applicants failed to clear the premises within the stipulated time, their commitment to the tenants through the tenant controller. Removed before the Supreme Court's tenants challenged the order in the High Court, but As a result, the tenants could not avail themselves. On request of the petition under section 144, the CPC restored the occupation that the area was removed from the landlord's allotment. The High Court upheld such a rent controller's order and directed it to provide landlords with vacant possession. The court will hand over the vacancy to the landlord but they have not complied with the order that the landlord was assigned the landlord on the tenants' commitment before the Supreme Court accepted the tenant once accepted respondents. Such a determination cannot be taken away because their landlord was bound by it. The landlords were not identified with any defect, in which case the appeal for leave of the High Court was denied.
