Civil Code of Conduct 1908 Section 12 (2) Constitution of Pakistan (1973), Article 185 (3) Application for rejection of order based on fraud and misrepresentation excludes such application by all courts, including the High Court. Appeal was granted to consider whether section 12 (2), in the application under CPC, for the fraud and misdemeanor / misrepresentation allegations, required the trial court to compile matters. And there was no need to decide on such an application after allowing the applicant the opportunity. Of these charges, the applicant was directed to submit the balance amount to the trial court within a stipulated period, in which his leave would be withdrawn.
