AGRICULTURAL DEVELOPMENT BANK OF PAKISTAN versus HAMIDA BEGUM
The constitution of Pakistan 1973 Arts 185 (3) and 199 lenders and the proposed schedule of lenders etc., which is a prerequisite for the issuance of the next installment, prevented the demand of interest on the money issued by the bank which made such demand. A constitutional petition was accepted against which the High Court further directed that the land for which the bank has a mortgage. The loan amount should be redeemed and the title documents should be returned to the applicant after the implementation of the necessary redemption process. The dispute of accuracy was that the High Court was not justified in working in its constitutional jurisdiction in connection with the contract matter and the relief given by it was not guaranteed.
