The earlier suit between the parties was settled on the LLP with the consent of both parties; the High Court dismissed the petitioner's request for transfer of the case on the ground that his marital relationship was earlier. In the dispute, the parties had agreed to hear their cases. In the opinion of LL \ Valdity Petitioner that his consent which had been dealt with in previous cases could not be construed as denying the application for transfer of suit, after which the dispute raised by the petitioner. An appeal was granted for consideration.
