ZAMIRUDDIN versus GOVERNMENT OF SINDH
Constitution of Pakistan 1973 Arts 199 and 212 Sindh Service Tribunals Act (XV of 1973), Section 3E [as contained in Sindh Service Tribunals (Amendment) Act (XXI of 1994]] to declare employees of Sindh textbook board as Government employees. The declaration, in front of Article 212 (2) of the Constitution, has allowed the employee of the Sindh Service Tribunal to challenge his suspension in a negative language after strengthening the High Court's jurisdiction under Article 199 of the Constitution. The jurisdiction of this section is expressly forbidden. Such a restriction of the Constitution is final where the provisions of Article 199 of the Constitution were governed by other clauses of the Constitution, then the constitutions have the absolute power and influence to control and the discharge is completed by the courts.
