MUHAMMAD SHAFIQ KHAN versus VICE-CHANCELLOR, ISLAMIA UNIVERSITY, BAHAWALPUR
Sections 30 and 24 Civil Procedure Code (V8 1908) of the University of Bahawalpur Act 1975, A XXXX, RR l & 2 of the Constitution of Pakistan (1973), Article 199 Constitutional Petition Temporary Order distinguished two members of the Senate nominated by such members. The nominee was challenged to request that the nominee's members (respondents) be prevented from attending the meeting of the syndicate central constitutional petition, which at the same time emphasized the request for interim relief. Under the Senate, nominated Senate members were selected from the Senate against which the petitioner applied. Given that such representation was unsuccessful and that the appeal was grossly false, in view of such a case, the respondents could not be banned from attending the syndicate meetings unless their selection was either revoked. There was no such power or the request for illegal interim relief and the respondents' participation in meetings was excluded, however, subject to the final decision of the BE constitutional request.
