GOVERNMENT OF THE PUNJAB versus GHULAM SARWAR KHAN
Authorization of Article 8 Constitution of Pakistan (1973), Article 212 (3) BP Section 19 of Punjab Civil Servants Act 1974. Government employees claim that vacant posts in BP Section 19 should have been promoted from that date as they were available on a specific date. Through the Departmental Authority Service Tribunal, however, the government directed that the government employees be determined from the date specified. The government claims that no public servant has the right to claim that it should be promoted from the last date, even though there was a vacancy on that date. Although claiming to be a development was true, the government had no mandate to restrict the development of public servants for some time, so officers in the sector could not do enough exercise.
