DIVISIONAL SUPERINTENDENT, PAKISTAN RAILWAYS, SUKKUR versus MUHAMMAD KARIM
The Industrial Relations Ordinance 1969 Sections 25A, 38 (3A) and 49 former Order Employer (Railway) were set aside on the ground that the legal adviser and the employer's lawyer who appeared in the petition was not allowed. The Pakistan Railway Officer (Divisional Superintendent) against whom the complaint was filed by the employees was not personally presented, though he had appointed a clerk to present the documents to the Netherlands Court, in many cases. If the Railway Superintendent would be personally present in all such matters, the Railway, in which the Railways were to be made a party, would be any other. RAW could not work, the former labor order submitted by the Labor Court was put aside, under the circumstances.
