West Pakistan Educational and Training Institution Ordinance 1960 Section 9 Government College, Lahore (General Terms of Service) Regulations, 1990, Regulation 4 Punjab Service Tribunals Act (IX of 1974), Section 4 Constitution of Pakistan (1973), Arts 199 and 212 Government. The College, Lahore was approved by the Provincial Government for appointment by the Principal of the Government College, Lahore for the purpose of the West Pakistan Educational and Training Institution Ordinance, 1960, as per Article 199 of the Constitution. Defendant's appointment as a respondent to challenge the appointment of a Government employee by the Government of College Thith had nothing to do with his terms and conditions of service so that such an appointment was challenged in the Institution, the College, to prevent the High Court from having jurisdiction under Article 212 of the Constitution. It was no longer subject to the powers and the control of the Government, the constitutional application for the position of the defendant as a defendant was not prohibited under Article 212 of the Constitution, nor was the notification of appointment of the Principal. On the contrary, the appeal was made under section 4, under the Punjab Service Tribunals Act, 1974, but was not related to its terms.
