MUBARAK ALI versus GOVERNMENT OF PUNJAB
On the basis of the Contract Act 1872 Section 2 (h) Constitution of Pakistan (1973), Article 185 (3), the services of such engineers were terminated while other engineers appointed on ad hoc basis were regularized through notification. 29 29 1990 The applicants challenged the termination of their services before the High Court through a constitutional petition, which ruled that the applicants were appointed on a contract basis, the contract expired. In fact, they had no valid justification which did not exist with the same arguments. The High Court reversed the figures before the Supreme Court's record shows that the services of ad hoc employees who were serving on an ad hoc basis were upheld since 1989. As such, the applicants were neither serving nor acting on an ad hoc basis. 17 The appointment was made on the basis of agreement in July 1989 but the decision of the High Court strongly indicated that the leave of appeal was denied in the circumstances.
