CHEF versus UNION COOPERATIVE CLUB LIMITED
In the terms of the Operative Society Act 1925 Section 70 Partnership Act (IX of 1932), the section 69 unregistered firm suits the name of the partnership firm Defendant, Section 70, the Cooperative Society Act, 1925 against such society. Filed without notice is a cooperative society suit. Although the plaintiffs claim that their firm is registered, they still failed to submit the registration certificate; the plaintiff, who failed to prove such a registered firm, was not sued in the name of the partner firm Defendants Co-operative Society. As such, no lawsuit could be filed. Unless it was first given notice under Section 70, Cooperative Society Act, 1925, the plaintiff also needed to disclose in such notice the cause of action, the name, the description and the residence of the claimant and the resident. There is no such notice in the claimant who intended to make the claim instead. The terms of section 70, the Cooperative Society Act, 1925, were not presented to the defendants, nor was the copy filed by the plaintiff nor the delivery of such notice mentioned in the suit filed by the plaintiff. Therefore, in view of Section 69, the Partnership Act, 1932 as well as Section 70, the Cooperative Society Act, was not sustained. 1925
