ABDUL GHAFFAR versus STATE
Section 302 Constitution of Pakistan (1973), Article 185 (2) (a), witnesses who were present on the evidence and witnessing the incident, fully supported the prosecution case against the accused. False disclosure was made by the trial court. There was no contradiction between the ocular evidence and the medical evidence, which was not presented in the High Court decision by the trial court to protect the accused from acquittal and record his conviction. It was maintained according to any weakness and punishment.
