MUHAMMAD SARWAR BHATTI versus GOVERNMENT OF THE PUNJAB
Punjab Local Government Ordinance 1979 Section 139 Punjab Local Council (Lease) Roll, 1950, R5 Constitution Pakistan (1973), Article 199 Constitutional application to exempt the company from the payment of stiff tax from the Government Municipal Committee (for collection of octroi). Challenges us. Waiver by the Government, whereby such a minor was declared by the Government without obtaining legal support, however, its support, in the challenge of exempt octroi taxation by the Municipal Committee. Was not made, and was found to be bound by the terms of the agreement. There is no place for the government to challenge Octroi's waiver, except that the terms of the agreement between Ajay and Leased clearly state that the difference between a leased and a leased resort is mediocre. Will have to resolve the differences between the parties. Thus, the terms of the contract may be provided to the applicant (lease) in a constitutional application for which both parties were bound.
