SIRAJUDDIN versus ABDUL GHAFFAR

Civil Procedure Code Order XLI, XI, Rr 23, 25, 29 and 31 of the CPC Appeals remanded the case by the first appellate court to hear the evidence of the Conan (Article 10 of 1984), Article 47. The trial court made two additional matters after the remand and asked the plaintiff to present evidence, but the plaintiff gave a written statement and did not present any evidence; the defendant's position was that evidence should be presented on all matters. The plaintiff's plea was that additional evidence could be presented on the additional issues and not on the issues that were decided in the previous appellate court decision. The trial court did not even consider the evidence on which the evidence was to be recorded, however, allowing the parties to add evidence on the additional. In the post-remand appeal, the plaintiff's first appeal was litigated by the trial court, and the trial court's ruling and order dismissed the plaintiff's appeal. The appellate authority is to provide the parties with an opportunity to be remanded by the trial court, including evidence on all matters, including additional matters, especially when the appellate court ordered the case to be decided again. This should not be explained in accordance with OXLIKR 29. , The CPC Trial Court and the First Appellate Court, thus, misunderstood the intention of the remand order in the post-remand proceedings, regulating the recording of evidence in such a situation under Article 47, Law E-Testimony 1984 1984 of reg. Where, however, the appellate court's remand order may be found. Article 47, the law shall not be followed for the exclusions set forth in this testimony, 1984, so as to record the latest evidence.
