LUQMAN versus THE STATE
The Pakistan Penal Code Section 337L (2) was adopted in the Cushing Amendment of the Criminal Code of Conduct (v. 1898), Section 555 Sessions Court Order, without the magistrate discussing and disclosing the evidence and defense version of the prosecution in his order. He also acquitted the accused. The Sessions Court remanded the trial trust magistrate and directed the Sessions Court to issue the order. In this case, however, the magistrate was instructed by the magistrate only to record the evidence of the medical officer to record the evidence as a whole and then strictly order the record to be recorded according to the law.
