ALI MUHAMMAD versus THE STATE
The Prevention of Corruption Act, 1947, Section 5 (2) of the Code of Conduct (XLV of 1860), Sections 161 and 409 of the Criminal Procedure Code (V9 1898), Section 5551, were allegedly criminalized in 1982, in FIR 1984. Four witnesses were examined in the trial court in 1988 on the directions of the charge sheet High Court, but they did not support the prosecution's case, and the rest of the prosecution's witnesses were refusing to give legal evidence against the accused. Approval for the action was given at Rs 36,140 while the alleged illegal amount was Rs 1,00,035 according to the FIR so that such action could be postponed. Going to trial is akin to abusing the trial court proceedings against the accused in a special court.
