MUHAMMAD HUSSAIN versus SALEH MUHAMMAD
The award was initially filed in 1986 when the notice was not submitted under the Arbitration Act, 1940, under section 14 (2) of the Arbitration Act, 1940. Both parties participated in the proceedings and filed their objections to certain claims. The award was sent to the arbitrator on the specified date in the presence of the counsel of the parties in the court on four specific occasions in which the parties were required to present their objections. However, the appellant's counsel stated before the court that the appellants did not want to file objections in such a factual position, there was hardly any need for the parties to enter the award under section 14 (2) of the Act. There was no need for the court to take any notice from the parties on the appropriate representation when the award was presented to the court at a particular date when it was presented by the lawyer.
