MUKHTIAR BIBI versus S.H.O., POLICE STATION NAWAN SHEHR, TEHSIL KABIRWALA, DISTRICT KHANEWAL
On the basis of the termination of the FIR in the constitutional application of Article 16/10 Constitution of Pakistan (1973), Article 199 Criminal Code (v. 1898), Section 249A & 265, the matter was disputed between the parties. Everything is Judicial. In a civil court, pending proceedings in a criminal court are generally halted until the trial of the civil court case against the accused applicants continues and the High Court's constitutional jurisdiction was not intended to deter the public. ? By performing their legal duties even otherwise, there were alternative and appropriate remedies available for the accused under Section 249A & 265X, CRPC, and the sentence taken before the High Court could be properly taken. And when this case was presented in Coj4rt the constitutional application was dismissed with limited observation.
