Section 115 (3) amending jurisdiction, the applicant's use was already challenged by the trial court's decision and decree which was revoked before the appellate court, which was rejected, by the applicant before the high court. The second amendment filed was expressly withheld under section 115 (3). Following the CPC courts exercising their jurisdiction, the decision cannot be interfered with in which the High Court cannot be interfered with in exercising its jurisdiction to modify it.
