MEHBOOB ALAM versus THE STATE
Foreign Act 1946 Section 2/3 Criminal Procedure Code (V9 1898), S, 561A, Responding to Proceedings Applicants' right to be Pakistani or foreign was subject to dispute and to record evidence only after the trial. It can be decided later. The credentials of the national identity cards which were seriously challenged were not enough to justify the contents of the applicants of Pakistan yet the citizenship of them was not established, hence any violation of their fundamental rights. There was no question that they could uphold their legal rights without having to relinquish their evidence before the trial court. The High Court was reached which was not appropriate in the court magistrates against the applicants.
