Along with the medical evidence of the recovery, the deceased was carrying a rifle which he had fired ineffectively at the time of the incident. After the victim and the accused encountered each other, a situation arose between them which prompted the accused to shoot. The deceased was sentenced to death by the trial court, however, inadvertently convicted and sentenced under Section 303 (a), PPC, which was not present at the time of the incident and was subsequently set aside. , The accused was instead convicted under Section 304, Part. 1, PPC and sentenced to imprisonment, which has already passed through the circumstances
