S.M. YOUSUF versus SETTLEMENT COMMISSIONER (SINDH)
The leave to appeal on the disposal of the Settlement Commissioner's order was passed by the High Court of Pakistan, 1973 (Article 185), Article 185 (3) of the Vacant Property and Displaced Persons Act (1975). Whether the High Court failed to appreciate it or not, the respondents (who were the petitioners earlier) had no locus standi to challenge the order of the Settlement Commissioner, as they were not required to make any plot. There was no right to transfer because under the High Court order in the initial litigation period in 1965, and even then, the same High Court letter P By the order of the Tent Bench and finally the decision of the Supreme Court, the question of their entitlement was presented.
