Paragraph 9 of the Sindh Chief Court Rules (o), R11 Constitution of Pakistan (1973), Article 197 Civil Procedure Code (v. 1908), Section 151 Transfer of an individual case from a High Court Judge to a High Court Judge to the Chief Justice High Court only By assigning cases to different benches by fixing / assigning rosters and extending the bench to allocate classes of specific cases and to form benches, such administration shall be deemed to have the administrative authority to transfer the vests of individual cases to the Supreme Court. The authority is only the court, and that too, in relation to the transfer of the matter from one particular High Court to another, The Chief Justice of Tea, thus, was not judicially authorized, nor was any authority given to a higher authority to move his case from a bench, which according to the Rooster was legally seized. And another bench of the same High Court in the same court had asked the Chief Justice to submit a petition. The officer had to transfer his case from one High Court judge to another High Court judge, thus was not workable and he would be able to be excluded.
