AZAM JAN versus HABIB BANK LIMITED, KARACHI
Article 32 Constitution of Pakistan (1973), Article 199 Constitution of Pakistan Ombudsman (Ombudsman) Order 1983, Article 199 Ombudsman's refusal to represent the President was authorized to pass such orders on representation as authorization. He deserves a hearing by the president. Before Article 32 of Order 1 of 1983 had not been issued, nor was the President required to give detailed reasons to support his order, however, it would have been possible for the President to settle the matter. Have you applied your mind first? The same court, using its extraordinary jurisdiction, will not sit on the appeal of the Ombudsman or the President's decision. Changing his opinion instead of his opinion will review the facts of the case, which was given to the High Court, not equivalent to his jurisdiction. In addition to the decision to dismiss the appeal of the Ombudsman, the President rejected the representation against the decision, neither had the jurisdiction nor the legal authority. Applicant had other legal remedies to substantiate his complaint and such treatment could not be considered inadequate treatment, in which case the judicial review against the order was rejected.
