AFROZ IHSAN HAQ versus FEDERAL GOVT. OF PAKISTAN.
Constitution of Pakistan 1973 Arts 51 (4), 199 and 175 (2) ??? Elimination of women's seats is reserved for a specific period ??? Is it legitimate ??? Could not the constitution be added or amended by the constitution itself? Courts become spokespersons, not lawmakers. ??? God's sovereignty should be exercised by elected representatives in areas of Pakistan. Parliament, the representative of the public, has no courts as a repository of divine sovereignty. Neither can the jurisdiction to invalidate any clause of the Constitution and restore any provision which has expired for a certain period of its power? The constitution itself can be amended by a specific process, not by the courts. ??? Thus, the High Court cannot restore specific seats for women who were abolished by the Constitution.
