Section 302 Constitution of Pakistan (1973), Article 185 (3) was granted leave of appeal to examine the argument that ocular testimony in respect of six of the seven persons who were tried by the High Court and the trial court. Did not accept. The rule of law requires that the seventh person (the present accused) should not be punished as long as there is no free association with regard to his role in the incident and such evidentiary evidence on record.
