MUHAMMAD HUSSAIN ALIAS MUHAMMADA versus STATE
Criminal Code of Conduct (CRPC) Section 497 Determination Code (XLV of 1860), Section 302 guarantees the fact that the accused did not surrender even though his close associates were charged with the crime and he was on his own. Knowing the allegations made, he justified the High Court without the technical satisfaction of the requirements of any declaration, in the case of conviction and bail for the purpose, in the case of the acquittal by the sessions court. The use of discretion by the High Court did not demand interference by the Supreme Court.
