NOOR NABI versus STATE
Sections 110/55 and 561 of the Criminal Code of Conduct (CRPC) were found to have been prosecuted under section 1110/55, CCPC, in the police report against the applicant under the ambiguous and common allegations. I was not a single person. The public was referred as a witness and the applicant was sent to judicial custody without any order passed under section 117, not contradicted by the CCP prosecution. The applicant remained in judicial custody for almost one year. Action against this is pending. Under Section 1110/55, the CCPC was dismissed under the circumstances of the petitioner, court magistrate.
