The Prevention of Corruption Act, 1947, Section 5 (2) of the Conduct Rule (XLV of 1860), Section 161 Constitution of Pakistan (1973), Art 199 were charged with terminating the FIR on the charge of being a gazetted officer, The approval of the Anti-Corruption Committee was necessary before the case could be filed. There was nothing in the record to show that any sanction was approved by the Committee, in the absence of such a legal requirement, the FIR was registered against the accused without legal authority. And it had no legal effect and was canceled accordingly.
