ASHIQ HUSSAIN versus STATE
RPX (AS) Temporarily Folded and Intercritical Orders OXXXX, R2 (3) Criminal Code of Conduct (V9 1898), Section 435/439 Ordinance XXX, R2 (3) The Civil Procedure Code Order XXXIX of the Revised Virtual Penalty, punishable by the Civil Courts under the temporary injunction violation of the CPC, was challenged by the Applicants under Section 3535/9439, PR. The competence of the PC criminal review was challenged on the basis that the civil court had sentenced the petition under Order XXXIX, R2 (3). To temporarily violate the injunction, it was a wrong approach by the civil court to act as a criminal matter, the matter being purely under the Code Code of Civil Code, on the objection that criminal revision was not authorized. There is a simple matter that is under consideration. For a long time, the criminal review was changed to one because the defendant's significant complaint was terminated due to a civil modification and the applicant / accused also suffered proceedings, which were done by the civil court in this way. The High Court dealt with the case without extending the detention period for the accused / applicant.
