HUSSAIN TRADING CO. versus JALAL BROTHERS (PVT.) LTD.
Section 16 (1) (2) of the tenant attacking the defense of the rent order shows that the tenant had to submit monthly arrears of rent arrears and future premises to the court. In the case of miscellaneous rent, the tenant did not submit the rent after passing the temporary rent order, but in the case of temporary rent, the temporary rent has continued to be submitted against the direction in the order. Such an error cannot simply be termed a technical default as a result of a misunderstanding or a major mistake.
