Section 302/34 Constitution of Pakistan (1973), Article 185 (3), both courts found evidence of prosecution for insufficient motive due to non-availability of witnesses in support of it while Supreme Court in support of it. The court refuses to intervene on the question of the amount of punishment. It included the principle of law, no such question was involved in this case; leave to appeal was dismissed.
