In response to the respondents' request for the transfer of the Plot Society to the Operating Society Act 1925 Section 54 Constitution of Pakistan (1973), Article 185 concerning the membership of the dispute society and in a written statement before the Deputy Registrar. Neither the allotment was disputed in favor of the previous allottee / transfer nor was it a dispute that the previous allottee had transferred the plot in favor of the respondent taken by the appellant before the government that the allotment in favor of the respondent was fake. And was against fraudulent cases. With regard to the appellant and the designated post under the record, the High Court held that the remand order passed by the Government was beyond the scope of hearing of the parties' requests and the same (remand order) was not lawful. Was declared and without any legal effect the court was not only fair and equitable but also did not face any legal weakness. The High Court order was upheld.
