QUTAB MUHAMMAD versus SETTLEMENT COMMISSIONER (LANDS)
Cancellation of informants applying for cancellation of allotment after the repeal of the Homelessness (Land Settlement) Act, 1958, Section 10/11, Land Allotment, 1958, claimed that they had also made the allotment earlier. An application for cancellation of the allotment was filed. Cancellation of Act, but Allottee objection, Informants' request for cancellation of Act was not applicable as there was no pending action at the time of Act cancellation, it was rejected by the Authority earlier. There is no order to restore the records of the action taken on the petition. It is alleged that the petition was filed by the informant against Alti, which was said to have been lost. The notified officer of the Authority made no serious effort to find out that in fact any earlier application was filed by the informant, the notification officer should have traced the record. The reasons for the absence of previous proceedings, if any, and if they were not available, should also be denied o The objections to the Allottee have been detected in maintaining the application of the informants filed after the Act's termination. Was wrongly terminated by the Authority
