Constitution of Pakistan 1973 Article 199 Homeless persons (Compensation and Rehabilitation) Act (XXVIII of 1958), Sections 10 and 11 were auctioned in favor of the applicant for cancellation of property auction but in the name of the first installment. Auction not confirmed. The various petitions filed by the applicants for verification of the auction by the applicant were not disposed of and instead the property was transferred by the authority to another person without notice and information to the applicant. A special order of cancellation of the auction in advance was without approval. Such transfer order was passed by the authority in favor of another person without hearing the petitioner, which the High Court declared as illegal in the exercise of constitutional jurisdiction remanding case and gave the applicant an opportunity to be heard.
