MUKHI CHATROMAL versus KHUBCHAND
Section 149 Constitution of Pakistan (1973), Article 185 (3) Appeal filed before the High Court, delaying payment of judicial fees has been dismissed. Failure to set the date for the payment of the correct court or the reduction was the effect of the High Court in defining the amount of the court fee. The delay in payment of the court fee for filing the date fee and correct payment will not be correct from the date of the last payment of the court fee, but from that date onwards the case / appeal was actually filed in the court. Failure to set a date within the court, or by which the court fee was to be provided and the failure to state the amount, shall be a prejudice against the appellants by dismissing the appeal for delayed payment. Will not justify the action. Due to court fee or bar limitation case, the High Court was remanded for hearing of the appeal on merit.
