The leave to appeal Article 155 (3), Article 185 (3) of the Punjab Pre-Emission Act 1913 was allowed to consider the argument that the Supreme Court did not change the principle laid down in the case of Sardar Ali. Nor has it been amended (PLD 1988 SC 287) that the plaintiff, who obtained the order for pre-arrest in the trial court before 31 7 1986 which was rejected by the appellate court, is superior.
