TARIQ ALIAS BABOO versus THE STATE

The West Pakistan Arms Ordinance 1965 Section 13E Criminal Procedure Code (V9 1898), was recorded the day before the completion of the section 242 offense but cannot be considered as a plea of guilty. The defendant was also not disclosed in this case. The court made some efforts to find out if the accused had given this statement voluntarily, and no trial lawyer represented it, and such a trial court should take extra care to find out. Whether the accused had voluntarily listened to the said request and did not expect any minor punishment and the conviction and sentence of the accused based on such plea was set aside and the accused was acquitted at the stage of acquittal. The case was remanded to the trial court for his arrest.
