RAFIQUE AHMAD versus TAFSEELA
Civil Procedure Code Order II II of the CPC Framework of Suite O 11, R 2, was previously based on a pre-sale contract. Under the Muhammadan law, the case later came out of sovereignty. The cause of action in the latter case was different and in the latter case the complaint of the former plaintiff did not arise from the same transaction but the Muhammadan law was born out of any right. In his written statement, he had raised an objection to the subsequent matter and no matter was presented in that regard. 0 11, R 2, prohibited under the Code of Civil Procedure, 1908
