Section 23 Constitution of Pakistan (1973), Article 212 (3) Seniority Appellant was selected for appointment to the Police Service by Competitive Examination in 1970 and joined the Police Academy in East Pakistan in December 1970 / January, 1971. The appellant could not complete his training for the time being. He was taken as a prisoner of war when he returned to Appellant Pakistan and completed his training in 1974 and was promoted to BPS 18 in 1975. On his representation by President Pakistan, the senator dismissed the service decision and assigned sanity to the defendants. The Supreme Court upheld the Tribunal's decision under Section 23, Civil Servants Act, 1973, under the retention of the President, under which respondents were assigned seniority to the appellants.
