ARSHAD MAHMOOD versus PUNJAB LOCAL COUNCILS ELECTION AUTHORITY
Telegraph Act 1885 Section 17 Local Council Election Local Council Election Authority declared the elections completely invalid and ten seats were reserved for the concerned local council. During the election process, the local council was restricted to eleven electoral units, Thus eleven people were selected. The election for ten boundary seats from eleven constituencies to the respective units of the local council was completely ruled out. The ceiling in itself could not control the number of seats in a local council. However, the power exercised by the former election authority, under the rule of section 17 of the Punjab Local Government Ordinance 1979, could not be mistaken for a decision in which the election authority had no right. And have full powers to ensure legal status. Until the election process is complete, the decision to revoke the local body elections completely, thus, was correct.
